Guardianship and submission of documents

At the beginning of the article, we will define what a guardian is: In general, every person has the right to make decisions for themselves. A small child does not know how to decide for himself, so his parents make decisions for him. There are situations in which a person is not capable of making decisions for himself, or the parent cannot accept responsibility for his child. We will assist you by sending a guardian and submitting documents.

There are 2 types of guardian: a legal guardian, and a guardian of property.

Legal guardian: The guardian assumes responsibility for a specific person and can act legally on his behalf.

Appointment of a guardian: The court decides who the guardian will be appointed, and issues a legal order appointing the guardian. Sometimes, the court will appoint more than one guardian. Who will the court appoint as the guardian?

In the case of an individual: the court will prefer to appoint a relative.

In the case of property: If it concerns the property of a private individual, the court will prefer to appoint a relative. When it concerns general, public, or business property, the court will appoint a body, or corporation. In the case of property belonging to the general public, the court will appoint an association that will take custody of the property.

When there is no one to appoint as guardian, the court will appoint the "general guardian."

In preparation for the guardianship, you must prepare a written request letter for the appointment of a guardian. The letter must be submitted to the Family Court.

An affidavit must be prepared, verifying the request for appointment as guardian, and signed by a lawyer or court clerk. It is advisable to attach to the documents a letter with a positive opinion from a social worker, explaining why it is appropriate to appoint the applicant as guardian.

In the event that the guardian is appointed for a medical reason, a medical opinion from the treating physician must be attached.

A fee must be paid for opening the case, and a fee for issuing an affidavit from the court secretariat.
