Personal delivery as required

Due process of law: A cornerstone of due process

In the world of law, the words “due process” carry enormous weight. They ensure that legal actions are carried out according to the required rules, laws and protocols, thereby giving them binding legal validity. In the context of legal documents, the concept of “due personal service” is critical. It does not only refer to the actual arrival of the document at the recipient’s hands, but also to the manner in which the service is carried out – in a manner that can withstand the test of the court. For lawyers, law firms and anyone involved in legal proceedings, understanding the meaning of due personal service and the ability to ensure it is key to preventing unnecessary delays, errors and complications.

What is due personal service and why is it so important?
Due personal service is an act in which a legal document (such as a statement of claim, summons, order, judgment, etc.) is delivered to the intended person only, in accordance with the requirements of the law and case law. The main meaning is that the delivery is carried out in a way that leaves no room for doubt that the recipient has indeed received the document and understood its meaning.

The importance of proper personal delivery stems from several critical aspects:
Ensuring the defendant's right to a fair trial: The law in Israel, as in many other countries, requires that a person who is being sued or required to appear in court be duly notified of this. Only in this way can it be ensured that that person is aware of the proceedings that have been opened against him and is given a real opportunity to defend himself and present his position.

Preventing claims of "non-receipt": When delivery is not carried out properly, the recipient can claim that he did not receive the document, or that he received it in a way that does not bind him. Such a claim may lead to the cancellation of proceedings conducted in his absence, the postponement of hearings, and in some cases even the cancellation of judgments rendered in the absence of a defense.

Prerequisites for the continuation of the procedure: In many cases, proper personal delivery is an exclusive condition for the court to allow the continuation of the procedure. Without proof of such delivery, the court will not allow hearings or a judgment to be held, which will result in significant delays and additional expenses.

Prevention of unnecessary damages and expenses: Delays in legal proceedings lead to a waste of valuable time for lawyers, additional legal expenses, and even financial damages for the plaintiff. Proper delivery saves all of this.

How do you ensure proper personal delivery?

For personal delivery to be considered proper, several principles and details must be adhered to:
Certain identification of the recipient: The courier must unequivocally verify that he is delivering the document to the correct person, whose name appears on the document. Often, this involves requesting the presentation of an ID card.

Physical delivery to the recipient: The document must be physically delivered to the recipient. It must not be left in a mailbox, on the doorstep, or with a third party who is not expressly authorized to receive it by law (for example, a family member of legal age living in the same place, in certain cases).

Detailed delivery documentation: The courier fills out a detailed "delivery confirmation" that includes the recipient's name, ID number (if possible), date and time of delivery, delivery address, type of document, as well as the recipient's signature on the receipt confirmation. This confirmation constitutes conclusive evidence in court.

Acting in good faith and in accordance with the law: The courier acts professionally, without deception or undue pressure, and in accordance with all legal guidelines and relevant rulings regarding delivery.

Handling special cases: In cases where the recipient refuses to accept the document, evades delivery, or is not at the address, a professional courier will accurately record the delivery attempts (including dates, times, description of the circumstances), to allow the lawyer to contact the court with a request for alternative delivery (such as delivery by publication).
